DHS Issues FAQs (Frequently Asked Questions) on Deferred Action Illegals Who Entered As Children

June 15, 2012 - The U.S. Department of Homeland Security (DHS) has issued answers to Frequently Asked Questions (FAQs) regarding the deferred action policy for undocumented immigrants who entered the United States as children. The policy comes under an executive order issued by President Barack Obama to afford prosecutorial discretion to certain aliens who entered the United States with their parents before age 16.
 
The FAQs discuss the following:
 
• Who is eligible for Deferred Action
• What is deferred Action
• How will the new directive be implemented
• Are individuals who receive deferred action eligible for employment authorization
• Does the process result in permanent lawful status for beneficiaries
• Why will deferred actions be granted for two years
• If an individual’s period of deferred action is extended, will individuals need to re-apply for an extension of their employment authorization
• Does this policy apply to those who are subject to final order of removal

The deferred action process permits qualifying aliens to remain in the country and apply for work authorizations which may be renewed every 2 years. To qualify, undocumented illegal aliens must have entered the United States by the age of 16, have no serious criminal convictions, are in school or members of the military. Obama Announces Deferred Action For Illegal Alien DREAMers To Stay and Work in US

June 15, 2012 - President Obama formally announced a program that brings immigration relief to thousands of undocumented individuals who entered the United States as children or with their parents, referred to as "DREAMers." This policy was implemented through an executive order prescribing prosecutorial discretion for eligible aliens. Under the deferred action policy, USCIS will exercise prosecutorial discretion to permit those undocumented aliens to remain the US and receive EAD cards that will last a period of 2 years. Such work permits will be renewable for two years upon expiration. The relief also applies to those undocumented individuals already in deportation or removal proceedings in front of an immigration court or judge.

To be eligible, such aliens must:

1. Have arrived in the U.S. when they were under the age of sixteen;

2. Have continuously resided in the U.S. for at least five years prior to June 15, 2012 and have been present in the U.S. on June 15, 2012;

3. Currently be in school, have graduated from high school, have a GED, or be an honorably discharged veteran of the U.S. Coast Guard or the U.S. Armed Forces;

4. Not have been convicted of a felony offense, a significant misdemeanor offense, three or more non-significant misdemeanors, or otherwise pose a threat to national security or public safety; and

5. Have been under thirty-one years old on June 15, 2012.

USCIS Announces Application Process for Undocumented Alien Dreamers

 
August 2012 - The Department of Homeland Security recently announced that on August 15, 2012, U.S. Citizenship and Immigration Services will begin accepting two-year permit applications for eligible undocumented youth, or DREAMers, under President Obama’s Deferred Action for Childhood Arrivals program. This program is designed to suspend deportation for some young illegal immigrants and accept applications that would grant them work permits. Those that qualify are undocumented immigrants between the ages of 15 and 30 that entered the US before age 16, resided in the country for at least five years as of June 15, 2012, have not been convicted of a felony, a “significant” misdemeanor such as burglary, sexual abuse, drug distribution, among others, or three other misdemeanors, and are currently in school, graduated from high school, earned a GED, or served in the military.
USCIS announced that the application requires a payment of $85 for the biometric fee. Individuals that wish to receive work permits, however, must pay, with limited exemptions, a fee of $365. The information provided on the form will be kept confidential and will not be used for deportation matters, unless the applicant meets USCIS criteria for deportation. 6. You have not been convicted of a felony, significant misdemeanor, or three or more misdemeanors, or do not otherwise pose a threat; and
