Questions You May Be Asked During Consultation

Here is a list of questions that an attorney may ask you during consultation:

• What is your current visa category?

• Visa expires on (mm/dd/yyyy)?

• Method of entry?

• Have you ever been out of status?

• If so, for how long?

• Are you currently employed?

• If so, is your employment authorized by the USCIS?

• Do you have a sponsor (individual/corporation) for your visa petition?

• If the sponsor is an individual, what is their relationship to you and what is his/her immigration status (i.e. citizen or permanent resident)?

• If the potential sponsor is a corporation, have they informed you of their willingness to sponsor your visa petition?

• If the potential sponsor is a corporation, what type of business does it engage in?

• What is your level of education?

• What field of study did you receive your degree in?

• Do you have any dependents?

• Will they also be filing for a visa petition? 

 


The following are documents that you may need:

• Passport

• I-94

• Copy of your current visa

• Copy of I-20 (for students)

• IAP-66s (for J-1 visa holders)

• Employment authorization document (EAD card)

• Marriage certificate (K visa applicants)

• Dissolution of marriage (K visa applicants)

• Proof of relationship (i.e. pictures and letters)

• Approval notices for prior visas

• Copies of professional license

• Copies of degree and/or college transcript

• Resume
